APFC (APAC Franchise Council) Member Standards

One of the hallmarks of a reputable industry is a commitment to high standards of conduct. The APFC Member Standards aim to enhance public perceptions of franchising, safeguard franchisor investments, protect franchise networks, and provide guidance for those starting their franchising journey.

The APFC encourages members to maintain standards worthy of franchise sector professionals. These standards guide acceptable conduct and help develop strong franchise relationships. The APFC believes the franchise sector is well-regulated with effective dispute resolution and disclosure provisions, and these Member Standards further promote best practices.

Members gain significant benefits by identifying with the APFC. Business practices should align with franchise best practices, reflecting these standards. While the Member Standards guide conduct, breaches will lead to disciplinary actions, including possible expulsion from the APFC. The APFC responds to complaints but does not police compliance actively. Use of the APFC logo does not certify compliance or endorse members.

Franchising Activities

All APFC members must conduct their franchising activities professionally and in accordance with relevant laws. They must comply with agreed standards of conduct.

Legal Compliance

Abide by all relevant state and federal laws, including the Franchising Code of Conduct and the Competition and Consumer Act. Provide documentation upon request.

Integrity

Do not imitate trademarks or other identifiers misleadingly.

Ethical Sales

Do not sell franchises to those unlikely to succeed.

Professional Conduct

Avoid illegal, unethical, or improper dealings.

Standards for Franchisors and Franchisees

  • Recruitment: Assess if prospective franchisees have the necessary skills and resources.
  • Support: Provide training and support processes.
  • Communication: Be accessible and responsive, fostering mutual understanding.
  • Dispute Resolution: Resolve issues through communication, mediation, or arbitration.
  • Fair Dealings: Avoid unreasonable fees and conduct.

Standards for Suppliers to the Franchising Sector

Professionalism: Lawyers, accountants, consultants, and other suppliers should adhere to these guidelines.

Integrity: Respect franchise systems, avoid inflaming disputes, and maintain confidentiality.

Transparency: Disclose qualifications, conflicts of interest, and any significant interests.
